Goo Hara suffered a long legal battle against her ex-boyfriend after he physically assaulted her, damaged her house, and threatened her with a sex cam he had taken without her consent. One of the judges who worked on the case is being heavily criticized for demanding to see Goo Hara’s sex cam in court.

Back in August, Judge Oh Duk Shik ruled that Choi Jong Bum (Hara’s ex-boyfriend) was guilty of property damage, physical assault, threatening, and forceful action. But he ruled that the boyfriend was not guilty for filming the sex cam.

He claimed Goo Hara knew that her boyfriend took the video and did not ask to delete it. Choi Jong Bum was only given probation for his crimes.

The victim did not consent to the video but it is difficult to say that she was not aware of him filming. The victim heard him filming and did not delete it.

Also, the defendant did not share or spread the video nor use it to blackmail her for money or sexually shame her.

Goo Hara’s lawyer fought the ruling and claimed that probation was not enough for the crimes that he had confessed guilty to or was found guilty of.

The judge responded, “We judge that the contents of the video is important,” and demanded to see the video in privacy of the court. Goo Hara’s lawyer reportedly rejected the request with rage.

It’s clear that the video was a sex cam and it may be understandable that the presiding judges would want to check for evidence, but it’s preposterous to have the video play in front of so many people even if it is in the privacy of the court.

Maybe it's just me, but I can't really fault the judge for wanting to see the video in order to make a verdict on whether it was a sex crime. Bc otherwise it would have just been 'he said she said'. I know it's uncomfortable for victims to know a stranger has watched something so intimate, but it's unfortunately necessary that an impartial third party watches such a video if you want to continue with the lawsuit 😣 But I don't understand why the judge didn't rule him guilty for threatening to leak it. I feel like that should be enough, even if he didn't go through with the threat

are people that dumb? there's a principle in international criminal law that's called "the controversy of the proof", all the substantial evidence has to be analyzed in court to be legal, how the fuck the judge is gonna take a fair decision if he doesnt watch the proof of the case?, it's illegal to verified a proof outside the court

I don’t know how court proceedings go in Korea but in my country they are not really private matters. Anyone can attend as long as they don’t interrupt proceedings, so for high profile cases there could be reporters and other GPs there.  If it’s the same in Korea then i understand why Hara and her lawyer will not consent to having the video shown in court. What the judge should have done is requested a private viewing with just the lawyers, defendant and hara present.

There's no need to show it to everyone at court

I think I have read somewhere that in the USA (and probably in some other countries as well) that a specialised expert witness (in that case from FBI or the police if I am not mistaken) acted as the trusted proxy to watch the video and then will be asked as witness on what he/she seen in the videos. In this way the video of sexual crimes don't have to be played in the court because not only can it hurt the victims if they are not prepared but it can also torment the watchers such in the case of child victims or violent cases. It is also harmful for the mental wellbeing of the expert witness but he/she have been trained and have stronger support systems to do their work. In this case, I think most likely having one police (preferably a female one) to watch the video and answered unspecific questions about what happening in the video should be sufficient (I hardly think the judges or anyone in the court room needs the whole details to make the rulings as many is most likely irrelevant). Here although the video is most likely to be non-violent but I also want to know the track records of the judge on whether he consistently asked to see the video recording of all sex crimes or only selected few. Moreover assuming there is no law in Korea that explicitly said that all evidences have to be examined publicly in the open court, a wise judge could ask to watch the video in his chamber with 1 prosecutor and 1 defendant lawyer present especially because it seems the ruling were entirely in the judge's hands with no jurors involved. 

The laws involving sexual crimes really need to be revised more progressively and more speedily to reflect the progress in the world.

People are just emotionally looking for a scapegoat. They're willing to blame anyone, even a judge who just did his job following the law.

I think people think it was an open court hearing and that the judge was asking for the video to be shown to everyone who dropped by that day, but I'm pretty sure it was a closed court hearing and he just asked it to be played for the judges at court. I've never heard of sex crime cases like this being open to the public.

Yeah, I agree. In addition, one news reported that only a few people who had given a Non-disclosure Agreement could see the video.
