Jung Joon Young Attends 1st Hearing + Admits To All Charges Made Against Him

On May 10 at 11 a.m. KST, the first preparatory hearing for Jung Joon Young was held for charges of violating the Special Act on Punishment of Sexual Crimes.

 

A preparatory hearing allows the court to determine how the trial should proceed in the future after hearing statements from both the defendant’s side and the prosecution. The defendant is not required to attend.

 

However, Jung Joon Young arrived at the Seoul Central District Court around 9:30 a.m. KST. Former Burning Sun employee “Kim,†who was indicted for charges of quasi-rape, also participated in the hearing along with the singer. In addition to the two, four lawyers for the defendants and a lawyer representing the victim also attended the hearing.

 

During the hearing, Jung Joon Young’s lawyers stated that the singer admits to the facts listed by the prosecution for the charges that are made against him. They also commented on the ongoing investigation regarding suspicions of aggravated assault and said, “The police investigation for Choi Jong Hoon, who is said to have been an accomplice [of Jung Joon Young], is in its final stage. It won’t take much longer [to wrap up]. We wish to hold a combined trial [for all of the charges].â€

 

The lawyers continued, “We suspect that there are two victims [of illegally filmed footage]. We see the need for the Ministry of Justice to appoint public defenders for the victims so that we can reach settlement.â€

 

The Ministry of Justice took the lawyer’s requests to hold a joint trial for all charges into consideration and set the next hearing to take place on June 14 at 11 a.m. KST.

This is still so strange for me to comprehend, did he really think he would get away because he put it in a chat...


Not only is he inhumanly evil but he's stupid as fuck....I feel so sad for his parents...all that love and work for this outcome.

They only have a few months worth of chat history that happen a few years ago.

All evidence are from that.

So that "all charges" might be just 1 percent of the stuff he has done over the years.

It is a disturbing thought...But I'd say that the probability is very likely.

Think of it as when the (raped) victims are in a helpless/defenseless state, whether they are under the influence of a controlled substance or unconscious. It's a seriously cruel act of violence.

 

I really hope there's something lost in translation because the use of the word "quasi" suggests this is somehow a lesser or even not rape.

Nah. Quasi-Rape is an actual thing.

 

III. Quasi-Rape (준강간)

 

According to Article 299 of the Criminal Act, the punishment for “Quasi-Rape†is imprisonment for a definite term of at least three years. An attempt to commit this crime is also punishable (Article 300). “Habitual offenders†may face more severe punishment (Article 305-2). In order to qualify as “Quasi-Rapeâ€:

 

1) A person has to engage in sexual intercourse with another person

 

2) By taking advantage of his or her state of unconsciousness or inability to resist

 

3) With the intent to commit “Quasi-Rape.â€

 

This crime specifically requires the perpetrator to take advantage of the victim’s “state of unconsciousness or inability to resist†as a means to engage in sexual intercourse. For the purposes of this crime, “state of unconsciousness†includes loss of consciousness caused by sleep or intoxication. “Inability to resist,†meanwhile, refers to other situations where the victim was unable to resist due to physical or psychological factors.

 

FYI: If the rapist was the one who drugged the victim, the crime would be “Rape,†not “Quasi-Rape.â€

 

Article 299 of the Criminal Act applies to “Quasi-Rape†cases where the victim is at least nineteen years of age. When the victim is between the ages of thirteen and eighteen, the Act on the Protection of Children and Juveniles from Sexual Abuse takes precedence. Meanwhile, when the victim is under the age of thirteen, the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes takes precedence. In accordance with these laws, the perpetrator could face life imprisonment if the victim is a minor.

 

When “Quasi-Rape†is perpetrated by “carrying a deadly weapon/dangerous object†or “jointly with another person,†the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes takes precedence. The crime becomes “Aggravated Quasi-Rape†(특수준강간), and the perpetrator(s) could face life imprisonment.

 

When this crime is perpetrated against a disabled person or a relative, the punishment is more severe as well.

 

Certain sex offenders may be required to wear an ankle monitor or be sentenced to chemical castration. At the same time, the sex offender’s personal information may be disclosed on the internet.

I wonder after he gete out of prison later will the other guys come murder him. I think they will because they all fall because he was some idiot who wanted trophies. If he had just deleted his chat like the others and destroyed burner phones instead of getting it fixed lol they would have never been caught. His was the equivalent of a murderer driving a car full of bodies in the trunk to a mechanic like hey can u fix my car? Lol like the staff isn't going to notice whats in the back? This idiot was begging to be caught

JJY was one of the (key) perpetrators so it was only fitting that he nailed himself to the coffin. His lack of judgement did cost others though. He must have pissed of people but for the people who were directly involved in these crimes can only point the fingers at themselves. If they didn't do the crimes in the first place they wouldn't be in these situations. Good for them, it serves them right.

Absolutely, he's being scorted to his home by police prior his pretrial detention. And also all his really closest famous people are being targeted with scandals, that's didn't happened with others implied like Seungri or Choi.

 

You have to think that they could have collectively undermine the chats as a proof of anything but since JJY from the beginning confirmed the validity of everything, that made that impossible then. On top of it he saved the proofs of everything (and I don't buy the "he's stupid and made big errors", so neither would be the others implied, I think. He's known as being really smart, not in the knowledge kind of but the street rat one's so, so many "mistakes" are starting to look suspecting).

 

I don't know, we will see. Also seems that he's the one who is going to have the highest prison time, so maybe that will stop them? Not idea. I really think that he's not dead yet because he's in pretrial detention.
