Would selling art of a real person be considered illegal? (I'm not selling my art but I submitted my artwork to a website that is selling Jonghyun inspired artwork to raise money for mental health, and the money is all being donated to charity) link if you're interested -> Blue Moon Project 

 

 

 

and someone said that selling fanart is illegal, which is true. But I don't see that as fan art since Jonghyun isn't a character or anything that qualifies as "fan art"

"It's not illegal to draw someone...you can't copyright your face. 

In theory they could bring charges against you for libel if the pictures were significantly damaging to their public image or if you copied from a photograph and it was sooo perfect it looked almost exactly the same as the original. 

But no...it's not illegal to draw a picture, drawing is a product of your artistic ability and your impression and personal opinion. 

Plus if any celeb tried to screw over a young artist making a few quid from selling pictures of them that didn't actually do any harm or break any real laws they'd look like a twit and the cost expenditure both PR wise and in trying to bring a case against you would be absurd in comparison to what you're doing."

if you copy from a  copy righted photo you might  have a problem. you need to change it enough that its a new piece of art.

^^^ this is important. there have been cases of artists making fanart of copywrited characters/photos and have been taken to court. in the cases the fan artists won over the original content creators bc the judge deemed the art with enough creativity that it deviated enough from what they copied. as long as it's not a carbon copy of the picture you're making it's fine.
