I'm kinda with Entropy on this one.

The super best case scenario is that Daniel gets off with just a fine (it will bother netizens enough if that's all he gets) and the group still goes on a long hiatus (because that's just how things are done after a scandal in SK) and then makes a comeback (but whether or not that comeback achieves anything is just as up in the air as if there will BE any comebacks for them). Or they take a short hiatus and then start promoting primarily in Japan (which means no comeback stages for Dalmates).

 

We already know the worst case scenario.

 

As for Dari's post... He probably does just miss being on stage. I don't honestly think he's in DMTN now anymore than David is.

Hey ya'll there's an update on the Daniel's case......his last and final trial will be on October 17 at 10am. They said right now he has a chance to escape jail time and might just get probation. But he also has a chance at getting jail time to be made an example out of.  

 

I just want a closure with the case and all. 

So Daniel can finally have peace and continue on with his life. Nonetheless, hope the sentence will be light T-T

Group DMTN’s Daniel, who is under court custody for being charged with mediating marijuana trade, has filed for an intermediate appeal.

According to legal circles, Daniel has submitted a petition for appeal on the morning of 21^st (of October) at the Seong-nam branch of the Suwon district court. It is made known that the appeal is to serve as an argument for the unfairness of the sentence received.

During the final trial which was previously held on the 17^th (of October) at the Seong-nam branch of the Suwon district court in Seong-nam city, Gyeonggi-do, Daniel had been sentenced to a 1-year imprisonment jail term along with an additional penalty of 7 million won. According to the prosecution, it was revealed that Daniel had admitted to the charges of mediating marijuana trade for a total of 15 times, from August last year until February this year, making this sentence an inevitable one.

Meanwhile, having already received his first sentence, Daniel’s appeal trial will take place at the High Court after the decision for the date has been made.

DMTN’s Daniel Wins Appeal, Jail Sentence Changed to Probation

DMTN‘s Choi Daniel, who appealed his one-year jail sentence for usage and distribution of marijuana, received the good news that his appeal had been approved. 

On February 11, Judge Kim Joo Hyun of the Seoul High Court changed Daniel’s one year jail sentence to three years probation. He said during the trial, “Because Daniel’s sister has promised to supervise the defendant and Daniel cooperated with the investigation, I have judged in his favor.â€

In addition to his probation, Daniel will have to do 120 hours of community service and 80 hours of  substance abuse rehab. 

Daniel was charged with using, distributing, and selling marijuana, along with other celebrities, back in March of 2013. He admitted to all charges and received a one-year jail sentence in October. He made an appeal and began his seven trial appeal in December. During his appeal, Daniel had asked for forgiveness saying that, “If you show me mercy, I will become a young man that is an asset to this country. Please forgive me.†His sister also promised to move to the United States to watch over him as he attends an American university. 

Daniel’s sister and his friends were present when they received the reduced sentencing, and celebrated with relieved tears.

That's kind of bittersweet.

I'm glad he won't serve time in jail, but there was that initial comment about doing military service, and now the comment about university in the US. It's great for him to pursue higher education, but if he backs out of military duty, he might as well never come back to SK (in fact, he could get the Steve Yoo treatment).

I suppose, given his age, that there's time for him to do both... but he would be better off (publicity and netizen-wise) to do the military service and THEN go abroad for college.

 

...plus I just want 2works to make an official statement on what the crap is going on with this group.

I agree. I also want an official update from 2works as well. What now? What will the rest of the boys do now that Daniel will be heading to the U.S? And isn't Daniel a US citizen?

I'm so happy for Daniel! He is really really LUCKY! I'm so glad he actually owned up to it unlike Bianca. He is  so lucky to have the support of his family, friends, and fans too. Btw I finally realize who this Bianca person is. Eww, I never liked her.

I agree. I'm going to need 2works to make an official statement about the group. I am optimistic. I think 2works are standing behind the group. I'm actually more concerned about a member backing out. That would be devastating especially without Daniel, and also given that Dari might not be in the group. Wtf we gonna do with 3 members? Well I guess there are some groups with 3 members like Phantom, Oneway, MFBTY (none are idol groups though). Hopefully the remaining members are still committed to the group. I'm kinda getting paranoid being that Inati, Jeesu, and Dari have kinda been together whereas Simon and Youngwon have been doing their own thing. Neither of them were on the "Healing" and "I like It" tracks that were released a few months ago

I would feel so bad for especially Inati and Dari and Daniel if this group disbanded. I remember Inati saying something along the lines of fearing that the other members would leave him because he feels they're all better than he is. Then Daniel would probably feel like it was his fault for the group disbanding and would have to live with that. As for Dari, he's got two Dalmatian tats.

LOL. 

Sorry but that's just hilarious. 

 

I want them to do a sub-unit or something. Keeping DMTN alive while Daniel is off of the public's eye and doing his probation. 

And yes, I am worried that a member might back out as well ... Ugh, at this point, I want them to take a group photo together :(

I just read this on AKP:

A few months ago, DMTN's Daniel was sentenced to prison for one year on the charges of smoking, dealing, and helping the trade of marijuana.  However, a decision was made after Daniel's appeal to change his prison sentencing to a stay of execution, meaning he will not go to prison as long as he stays clear of all crimes during a specific period of time.

 

It was revealed on February 11 by the Seoul High Court that he will have a three year stay of execution, which if he fails to stay out of trouble will result in the original one year imprisonment.  In addition, he will have two years of probation, 120 hours of community service, 80 hours of substance abuse rehab, and a fine of 7,168,000 won (~ $6,700 USD).  

 

The judge said at first, "Daniel was involved in a number of criminal acts in this case."  However, he considered that there was no prior criminal record and that Daniel grew up in America where marijuana is legal in some states. The judge also noted Daniel's cooperation in the case, and that his sister promised to thoroughly watch over him as Daniel will be attending college in America; therefore, the judge ultimately decided in favor of the defendant.  

 

Daniel, his family, and his friends all cried of happiness upon hearing the news.

So it's 2 years of probation instead of 3. 

What's the difference between "execution" and probation anyways?

I totally flipped when I saw that Jeesu is gonna join a new group :( 

 

But I guess it's something that we all have expected deep within us. That DMTN is beyond salvation. Despite how negative and pessimistic it sounds but it is the truth. What they can do now is to move on I guess. Moreover, they aren't young anymore. They don't have the time and youth like what current idols have. They don't have much time left in whatever they can manage to have a singing career. Guess in the long run it's the best for everyone .... It just sucks for us Dalmates. :(

I think they'll be lifelong friends. They're all so close and they jump at any opportunity to support each other.

But...no matter how much I would want a comeback its not going to happen.

 

It just breaks my heart when ever a picture of most of the members together is posted, or whenever Dari releases something for his solo, etc a lot of Dalmates get all excited and think its a Dalmatian comeback or post comments begging for a comeback and saying how much they miss Dalmatian.

Does that mean we should move on
