Regarding performing on music shows in general, I've seen some people say when her "real" contract with SM (the 3 year contract that is supposed to expire with SNSD member's, so around nowish) ends she will be free to perform on music shows..? Is that likely?

Then again if the SM-blocking-JYJ thing is legit that carried on for, well, ever..

The early release with conditions is very likely. Especially with what she's said recently with arranging a performance and now her appearing on All The KPop.

 

JYJ are being blocked because they sued SM.

Maybe Show Champion is the music show she's been in contact with to perform on. It would line up with the theory that she's been off Music Shows due to an agreement with SM for letting her out of her contract early.

Yes. She most definitely signed a non-compete clause to get out earlier, preventing her from performing on music shows until her 3-year contract (signed in 2014) is over.

I don't think this is what she meant. This is just an interview, not a performance. I'll believe she's not being blocked when she promotes on an actual music show on stage.

 

Here's where she said she made arrangements for a performance. It's the fact that she's on MBC Music's YT channel that is important. It means they might be preparing for her to be on Show Champion.

this non-compete clause doesn't make any sense in jessica's case- if you sign a non-compete clause, you agree not to start a similar profession in competition against the employer you left. but she is signed under a new agency, has released albums and had fanmeets/concerts, so she did the exact opposite of what a person would do, who just signed a non-compete clause. or am i missing something here? if sm wants to block you, they'll just do it, they don't need her permission, so why would she sign a contract with a non-compete clause that doesn't benefit her at all?

I think those that believe such a clause was signed think it only pertains to her promoting her work against SM.

With how SM believe they own people and their fame. It kinda does. SM wouldn't want to her to perform on a show(which is proper promotion) and cash off the fame they believe they garnered her.

i know, they are definitely blocking her, but why would jessica sign a contract and voluntary allow it? why would sm need that non-compete clause in the first place?

Why would she do so? To get the hell out of SM? As for why SM would...well, it's legally binding and they can't get in trouble for it(via JYJ Law or whatever). That said, I'm just playing devil's advocate here...

wait to get out of sm? didn't sm confirm they wanted her out of the group because they didn't approve of her business? jessica wanted to stay but wasn't allowed, that's what both sides seemed to imply.

Why wait(two years) when you can get out now...plus, SM would have most likely just kept her in their dungeon(and it seems like they already had her there). I HIGHLY doubt we would have gotten With Love, J and Wonderland if she was still with that company. I loathe the guy; but, even Oniontaker suggested that SM was under no obligations to give her anything musically. Jessica wanted to stay in SNSD...once she was kicked out, what purpose did staying in SM serve her? SM was more a hindrance to her solo career than a benefit.

i was under the impression that jessica was not allowed to renew her contract because of her business, which brings me back to my original point, why would she sign a non-compete clause with sm, who just kicked her out?

No, she re-signed in 2014...had three years to go in SM. Again, why would she want to stay in a company that wasn't doing anything for her as far as her musical solo career goes? If such a clause exists as a means of getting out of SM, I don't see why she wouldn't agree to such a stipulation in order to get free of SM. It would be better than suing the company and trying to get out that way(which isn't always successful...ask Luhan...or has repercussions from a butthurt company...ask JYJ)...and much better than waiting while you're unable to put out any music for your fans.

 

She was kicked out of SNSD, not SM. SM still had her under contract until they agreed to terminate it in 2015.

lol Yeah. Read the statement back then...they said she was no longer with the group, but that she was still under them. Or read the statements of them terminating the contract about a year later. Though, seeing as how she can't perform on music shows, it's not really "just let(ting) her leave", is it? As for the rest, like I said, most believe the clause only pertains to her ability to promote her work against SM's artists...or as I said earlier about SM thinking they own Jessica's fame and not liking that she makes money off it. And they can't keep her from saying things as long as she doesn't directly say it's them(as then they could sue her for libel or defamation)...

you're right, she officially left the company in 2015 not 2014

the non-compete clause still makes 0 sense for sm, since they don't need it if they want to block an artist, and jessica still made money with her music after she left under a different agency (why would sm allow that under their new agreement?) idk what happened bts either lol

You're right. But, as I said before, that wouldn't be legal...in fact it's downright illegal and they could get in trouble if exposed thanks to the JYJ Law. Again, the clause would just be better as it's legally binding(Jessica can be sued if she were to break it) and it keeps them from getting in trouble by doing it "properly" through legal channels...in other words, legit is better than illegal methods.

 

Jessica did make money; but, not as much as she could make if she were allowed to properly promote her music on a national stage/level and the mass exposure that would garner her. As for why they wouldn't just cut her off completely? Perhaps it's just simply that Jessica was unwilling to agree to that much for her freedom. What's the use of being free if you can't do one of the things you love?

the jyj law never passed in congress and so it's not effective (not like sm couldn't find a way around it)

this sm/jessica thing is just a mess, every party involved could have had it all...
