Drama is not over yet... despite A deciding to drop charges after negotiation with SM, the police are not dropping the CRIMINAL investigation into sexual assault and will forward the case to the prosecution.

 

For those who do not know, prosecutors are the major investigative force in Korea. Only they have the power to indict and press charges. The police recommending the case to the prosecution means that there is still blood in the water.

the police are moving really fast on this case. it's just awful all around - for the girl (who for whatever reason dropped the charges), for onew himself, for the cast and crew of onew's drama and for the other 4 members of shinee - and to be quite honest, i don't see their reputation recovering anytime soon. 

 

 

i'm not saying this with a sense of delight or anything. it's just awful that all of this shit had to happen so close to shinee's comeback and dome concerts and to taemin's comeback and concert as well.

On August 14, the Seoul Gangnam Police Station revealed that SHINee member Onew’s sexual harassment case will be passed over to the prosecution as a recommendation for indictment without detention.

 

According to the police, Onew is receiving a charge for touching a specific part of a woman’s body three times while intoxicated at a club in Gangnam on August 12 at around 7:10 a.m. KST. At the time of the incident, the woman (hereafter referred to as A) was dancing on a platform 30 centimeters (approximately 11.8 inches) from the ground, while Onew was sitting on a chair next to the platform.

 

After receiving the report from A’s acquaintance, the police arrested Onew and investigated him for five hours before releasing him. He said during the investigation that he does not remember as he was intoxicated. According to one witness, he seemed too intoxicated to stand properly and appeared to be grabbing her leg as support.

 

The site of the incident is a zone that is not captured by the CCTV (video surveillance). However, the police judged that the main witness account has credibility due to accurate descriptions of the surrounding movements which were captured on CCTV.

 

Previously, SM Entertainment revealed that A dropped the case because she acknowledged that the incident was something that could happen because of intoxication.

 

A police source commented, “The victim has received additional damage as her personal information has been revealed because of press coverage. She signed the form to drop charges due to SM’s request, but she testified that there is no change in the fact that the sexual harassment occurred.â€

The article said. that he is indicted and the case sent to prosecutor. If this article is correct...it means there is ground for further investigation. This can only be proceed from the prosecutor office.

 

(Seoul-Yonhap News) Hyeon-han reporter Hyun-ran Seoul -plans to send a popular group shinee member Onew (28, Lee Myung-ki) to the prosecution on the charge of indictment on charges of allegedly torturing her .( not sure what this means? ).

 

According to the police, Onew is suspected of having touched three body parts of a 20-year-old woman who is drunk at a famous club in Gangnam on August 12 at 7:10 am.

i think you should change that title bc isn't sexual assault synonymous with rape? pretty sure the charges were for sexual harassment.

 

 

 

sexual assault is used to describe instances of unwanted sexual aggression up to but not including rape. rape is penetration, sexual assault is anything of a sexual nature that doesn't involve penetration. 

 

 

edit: but yes, the op should have used sexual harassment.

I mean. I'd be scared to say no to SM, too. I feel bad for this girl having to deal with that even after having that kind of night.

There's a high likelihood it'll be dropped even if it is forwarded to prosecution, since the witness they're quoting basically said nothing happened. I feel horrible for the young woman, though. They mentioned her information got out, and while I'm not sure whether that means she's been harassed by anyone, it's a bit embarrassing. I hope she doesn't suffer anymore because of this. She was kind in dropping the charges, she doesn't deserve mistreatment.
