For people who don't know: because the husband is "at fault", according to Korean law, as long as the wife refuses to divorce, the court is likely to agree with her. Meaning that whether they divorce or not is 100% in the hands of the wife.

 

So there's no "he should've first divorced her" situation here, duh.

It's a weird situation because as long as they're married he has no legal obligation to care for her, (a husband while married, does not legally have to look after his wife) so financially she'll be in a better position if she divorces him. In Korea and many countries though, men want their women to stay at home and not work. And now that the marriage ends due to the mans infidelity, why doesnt she deserve some of "his" (their) money? In a lot of marriages, one partner (often, but not always women) sacrifices their career and financial independence to take care of the home and children. When the marriage ends, this partner is left with no career or financial savings to go on, which is why alimony exists...Sometimes it is a matter of greed but oftentimes not...
