...on a petition filed by Shayara Bano seeking 'Triple Talaq' [at one sitting] to be declared unconstitutional. The govt today filed an affidavit in the SC stating that the practice of triple talaq not be regarded as essential part of religion and the validity of triple talaq and polygamy be seen in the light of gender justice.

 

Bano: I was always hopeful that the government will speak in favour of women’s rights and that has happened today...turning a blind eye to how much women in the community have suffered due to such practices...Yes, the women’s movement is now speaking about this, several organizations that work for gender rights in religion are also taking up the cause...They must reflect of the what these practices mean to the women in the community, the mental torture that so many women have to go through because their husband can simply summarily divorce them on any pretext and it happens. So many women are subjugated, blackmailed because of the threat that if they don’t give in, they would be summarily divorced.

 

Triple Talaq prevents men from killing wives: AIMPLB's affidavit

 

The AIMPLB sought dismissal of a PIL by a Muslim woman [above-mentioned Shayara Bano], who has challenged the validity of instantaneous and unilateral pronouncement of triple talaq, apart from a ban on polygamy. It is on her petition that the board was asked by a bench, led by Chief Justice T S Thakur, to submit its response.

 

The All India Muslim Personal Law Board, defending the validity of triple talaq before the Supreme Court, has said that if the practice is discontinued, a man could murder or burn his wife alive to get rid of her. “If there develops serious discord between the couple, and the husband does not at all want to live with her, legal compulsions of time-consuming separation proceedings and expenses may deter him from taking the legal course. In such instances, he may resort to illegal, criminal ways of murdering or burning her alive,†stated the AIMPLB’s affidavit, submitted in court Friday.

 

Advocating polygamy, the AIMPLB said that polygamy was a “social need†and a “blessing†for women because “an unlawful mistress is more harmful for social fabric than a lawful second wifeâ€. The affidavit argued that the death rate of men was higher since it was mostly men who died in accidents, and since women outnumbered men, not permitting polygamy would force women “into leading a spinster’s lifeâ€. “Polygamy ensures sexual purity and chastity and whenever polygamy has been banned, it emerges from history that illicit sex has raised its head,†stated the affidavit. It added that if polygamy is not allowed, a man would divorce an ailing wife, or he might have an extra-marital relationship.

This is not marriage! If one side is has the power and the other side just give in this is called slavery imo. Even the law is taking the man side, what kind of life is this?! And wtf is AIMPLB?!

The All India Muslim Personal Law Board - a non-governmental, non-legitimized in any form, self-proclaimed custodian of Muslim laws in India i.e. basically a lobby group of patriarchal Muslim men who presume to speak for all the Muslims and threaten the govenments with dire consequences if anything different to their choices happen. Fed up by the regressive and repressive behaviour of this group, a separate AIMWomen'sPLB was created in 2005, which supports re-interpretation of Quranic law-system to allow women better justice and protection while remaining within the bounds of Islam. There are also two large Muslim-law oriented moderate organizations, one of which supports Muslim law codification done with modern standards and another one outright wants a secular UniformCivilCode. AIMPLB is supposedly trying to create hullabaloo and communal animosity around this issue because it fears its diktat may not run unchallenged anymore.
