Would you guys tell the teacher if the kid next to you cheated during exams/quizzes??

I just took a programming exam and the guy next to me kept looking at and searching on his phone (we weren't allowed to have phones out). He did the same thing during a quiz some time ago. 

This is irrelevant but for like 70% of the class (2 hours) he's looking up fitness related stuff on the internet and looking at videos of buff guys exercising. 

 

I know what he's doing is not right and he probably won't last long in this uni but at the same time I'm a bit reluctant to tell the teacher because I could get him expelled (I know technically, he would be the cause of his expulsion, but still). I don't think it's fair to any of us in the class, who work hard, if he gets to pass.

Someone once straight up cheated off of the final exam of a guy I knew (who didn't notice but all of the rest of us did) and he felt obligated to report it not only because the guy was a complete jerk but because it was just unfair. Also it was an easy class so how much did he not pay attention to the class to have to cheat on literally the easiest exam ever?? Like we literally were given a packet with all of the answers on it by the teacher and the exam was the exact same thing. 

 

I think the guy ended up getting in trouble but idk it was the last class on the last day of school so we all just left, although I'm pretty sure the cheating guy's friends tried to threaten the guy who reported him but they never did anything the next school year, it was just empty threats.
