Kim Hyun Joong wins case against ex-girlfriend

 

 

Kim Hyun Joong has won the case against his ex-girlfriend A, who first sought damages for alleged assault and a subsequent miscarriage. 

On August 10, the Seoul Central District Court found in favor of Kim Hyun Joong in the long-fought case between him and his ex-girlfriend. Ms. A had sued Kim Hyun Joong for 1.6 billion Won (~$1.46 million USD) in damages for psychological distress and injuries, but she's now been ordered by the court to pay the star 100 million Won (~$91,400 USD) for defamation of character, psychological distress, fraud, extortion, and more.

 

The controversy began in August of 2014 when his ex-girlfriend A pressed charges, and though Ms. A was previously cleared of charges of defamation, fraud, and extortion, it appears the court found in favor of Kim Hyun Joong after his latest appeal this past June. He and Ms. A currently share custody of their child.

Prosecution updates on the legal battle between Kim Hyun Joong and Choi 

 

 

According to the September 22 ruling of the ROK Army prosecution, Kim Hyun Joong was acquitted of all the charges his ex-partner Choi brought against him, including blackmail and fraud. 

Kim Hyun Joong had filed suit against Choi with charges of blackmail, fraud, false accusations, defamation of character, and more last July, and Choi had countersued the actor with charges of false accusations and defamation of character. The prosecution arrived at the conclusion that none of the charges filed by Choi was valid. 

 

Prosecution deemed that there is little to no credibility behind Choi's claims that she had to receive a six-week medical treatment for her fractured ribs which resulted from Kim Hyun Joong's alleged assault. Choi had reportedly said at the hospital that the injuries were from bumping into workout equipment, and the fact that she refused to provide a medical diagnosis only served to void her claims further. 

Additionally, as the 600 million KRW settlement amount to cover up the assault and miscarriage is considerably large, prosecution judged that it is hard to believe Choi's claims that she never blackmailed Kim Hyun Joong. 

Prosecution arrived at the conclusion that Kim's charges of blackmail against Choi cannot be deemed a false accusation as the text messages which were leaked in the media greatly contradicted Choi's claims. Prosecution also judged that Choi's mother's text messages to Choi seemed to suggest behavior that is conducive to blackmail. 
 

Choi's claims that she experienced a miscarriage due to assault and that Kim Hyun Joong demanded for her to get an abortion were deemed unsubstantial, as well, based on documented material from the hospital that she was not with child at the time. 
 

Previously, this past August 10, Seoul Central District Court had also stated that it cannot accept Choi's assault and miscarriage claims as true, and ruled for 100 million KRW to be returned to Kim Hyun Joong. 

Kim Hyun Joong was also acquitted of the defamation charges Choi filed against him. Prosecution judged that Kim's interviews which were covered extensively by the media were not defamation toward Choi but rather, a response to Choi's interviews. The false accusations of defamation which Choi filed against Kim Hyun Joong were also dropped for the same reason. Because Kim Hyun Joong's lawsuits were not based on fraudulent grounds, prosecution concluded that they cannot be ruled as false accusations.

As the reports revealed on September 22, prosecution gave their ruling on the criminal action lawsuit between Kim Hyun Joong and the plaintiff. We write this to deliver Kim Hyun Joong and the agency's official statement on the matter. 

 

 

The original case involves Kim Hyun Joong filing suit against the plaintiff for false accusations, blackmail, fraud, defamation of character and the plaintiff's countersuit against Kim Hyun Joong for false accusations and defamation of character. As Kim Hyun Joong is currently an active duty solider, the 30th army division's prosecution had taken charge of this investigation. 

 

 

On September 22, 2016, the army prosecution arrived at the ruling that Kim Hyun Joong is not guilty of the the charges the plaintiff brought against him, such as the false accusations of false accusations, blackmail, fraud, and defamation of character through [media] publications. 

 

 

The army prosecution's not guilty verdict is in the same vein as Seoul Central District Court's ruling for the indemnification suit between the plaintiff and Kim Hyun Joong which was announced this past August 10, ordering the plaintiff to 'return 100 million KRW to Kim,' and the plaintiff proved once again in this criminal trial that her claims and excuses are false. 

 

 

The plaintiff has continously spewed lies and filed all sorts of suits in order to taint Kim Hyun Joong's character and for monetary gains. After she filed her first lawsuit, [the plaintiff] threatened Kim Hyun Joong, and even after receiving 600 million KRW under the pretext of making a settlement, she continued to reveal private matters to the media, continuing to deny the reported truths even though they were undisputedly acknowledged.

 

 

Kim Hyun Joong will continue to diligently serve the remainder of his conscription and will continue to resolutely deal with any further legal disputes.

Kim Hyun Joong to be discharged from the military in February 

 

 

Kim Hyun Joong's mandatory military service will be coming to an end very soon.

 

On January 3, Key East Entertainment revealed, "Kim Hyung Joong will be getting discharged from the military on February 11."

 

The star enlisted back in May of 2015, but due to unknown reasons, his discharge date was never confirmed, and confusion arose as to whether he would be returning in February or March. Now it's been officially confirmed that Kim Hyun Joong will completing his duties and returning next month!

On January 11, the appeals trial was held for the singer's case regarding damage compensation.  Choi's lawyer stated, "From the originally agreed amount of 1.6 billion KRW ($1.34 million USD) in damage charges, the amount was changed to 700 million KRW ($588,000 USD)."  The reason for the change was, "In the process of deciding whether the two people want to start their relationship over, and Kim's parents rejecting Ms. Choi's offer, a compensation for damages was established due to mental stress."

 

According to a source, King Hyun Joong's side revealed a total of 600 million KRW ($504,000 USD) in settlement money was paid, violating the settlement.  

 

On the other hand, Kim Hyun Joong's legal representative stated that Ms. Choi agonized Mr. Kim in faking a pregnancy, and insisted the related context is accurate.  Regardless, "Kim Hyun Joong believed her at that time when she claimed to have a miscarriage after the singer assaulted her. She then submitted documentations relating to the pregnancy, eventually leading to a strong response."

 

Also, "leading up to his military enlistment, not only was Kim Hyun Joong faced with incredible defamation, it's the question of whether he can recover and resume his celebrity life," the representative commented.

 

It was also revealed back on January 6 that Ms. Choi was charged with defamation and attempted fraud according to the prosecutors' publications.  

 

The court revealed, "This appeal's future trial will be determined after carefully reviewing the necessary documentations provided by the prosecutor," upon entering, without confirming any dates for the second trial.
