Courts give ruling on Kim Hyun Joong and Choi's fight over their child

 

 

The plea date between Kim Hyun Joong and Choi's paternity lawsuit took place privately at Seoul Family Court on April 25. 

Subsequent the plea date, both Kim Hyun Joong and Choi's sides revealed that "the paternity lawsuit will be retracted." Kim Hyun Joong's attoreny Lee Jae Man told Star News, "The paternity lawsuit [between Kim Hyun Joong and Choi] has wrapped up." 

 

Lee elaborated, "The courts ruled that [Kim Hyun Joong and Choi] will have joint custodial rights over the child. The child's caretaker was not designated. Though the parental rights have been ruled as joint custody, there could be another lawsuit from the plaintiff's side for sole custodial rights over the child. We foresee another lawsuit related to the parental rights in the future." 

 

The lawsuit from Choi for alimony, parental/caretaker rights, and child support was withdrawn based on the court's stance that they could not make a ruling on the lawsuit as it was filed not in Choi's but the child's name. 

 

Choi's attoreny, Sun Jong Moon of Sun and Partners, reportedly stated, "The paternity lawsuit has terminated, and the rest of [the issues] will be taken care of at a later time."

This will be a particularly special event for the group and their fans, as June 8 is SS501′s eleventh anniversary.

 

SS501 debuted as a five-member group on June 8 of 2005 with their first mini album entitled “Warning.†As members Kim Hyun Joong and Park Jung Min are currently in the military, members Heo Young Saeng, Kim Kyu Jong, and Kim Hyung Jun have been promoting as SS301.

Kim Hyun Joong's ex-girlfriend found innocent of all charges

 

 

A final ruling on Kim Hyun Joong's case regarding him and his ex- girlfriend Choi has been announced. 

 

Back in July of 2015, Kim Hyun Joong sued his ex-girlfriend for defamation of character, false accusation, fraud, extortion, and more. Then on June 23, various media outlets reported that Kim Hyun Joong lost his case against Choi due to lack of proof. As a result, the case is now closed with Choi innocent of all charges. 

 

Meanwhile, Kim Hyun Joong and Choi have joint custodial rights over their child.

Ex-girlfriend Choi requests that Kim Hyun Joong make a sincere apology

 

 

Ex-girlfriend Choi, who was ultimately found innocent of all charges, wants Kim Hyun Joong to sincerely reflect on his past actions. 

 

Choi's legal representative stated, "The final ruling was made on the 19th of last month, however, it was kept on the down-low to prevent media play. Choi has suffered day by day as she was mistaken for a fraud. She has been found innocent of all charges, but Kim Hyun Joong still has not apologized or shown any signs of reflection." 

 

The representative continued, "Kim Hyun Joong turned Choi, who is truly the biological mother of their child, into fraud and an extorter, which destroyed her character. She is now officially innocent, however, she has greatly suffered from the tortures of his fans. He needs to reflect on his actions, and must provide an apology."

Kim Hyun Joong and Ms. Choi to both be present at upcoming plea date

 

 

Various media outlets reported that Kim Hyun Joong himself will personally be attending the upcoming trial which will proceed on July 8 at 2 p.m. 

 

Kim Hyun Joong's attorney Lee Jae Man informed reporters on July 6, "Kim Hyun Joong will take a leave from his military duties and attend the trial to take place on July 8 at 2 p.m." 

The trial marks the second plea date for the 1.6 billion KRW (~$1.38 million USD) compensatory damages suit which Kim Hyun Joong's ex, Ms. Choi, filed against him. 

 

According to Lee Jae Man, the trial will proceed privately on July 8, with interrogations of any witnesses at 10 a.m. Then at 2 p.m. on the same day, both Kim Hyun Joong and Ms. Choi will attend the trial to stand before court and argue their case. 

 

It was also reported that Kim Hyun Joong has hired another attorney to represent him for the ongoing lawsuit. The lawyer was said to have relayed, "I'm doing my best to prepare for the plea date." Key East spared little details regarding the new addition to Kim Hyun Joong's legal team, telling My Daily on July 6, "Kim Hyun Joong did not switch lawyers but rather, appointed another one. We cannot provide personal information about the lawyer, and it's irrelevant to outcome of the trial."

Choi's best friend stands as a witness and elaborates on Kim Hyun Joong's past actions

 

 

Choi's best friend, Ms. Im, attended the trial on July 8 to stand as a witness on the claims against Kim Hyun Joong.  

 

Ms. Im is a close college friend of Choi, who reportedly talks to Choi on an every day basis. Ms. Im stated, "Back in summer of 2012, I first heard about their relationship from Choi. Then in July of 2013, Choi told me that she aborted Kim Hyun Joong's child. I've never met with him myself though. Then in May of 2014, I was shocked to hear Choi telling me that she is once again pregnant with his baby. She said she was scared, because she has already gone through one abortion, but Kim Hyun Joong told her to abort the baby again. I was mad, and I was also there for her." 

 

She continued, "In June of the same year, I heard that Kim Hyun Joong violently hit Choi. I asked her why, and she said it's because she demanded they break up after finding out that he's slept with girls from adult entertainment bars. I couldn't believe that he actually hit her, even if he was extremely mad. Choi's left cheek was swollen, there was a big bruise under her left shoulder, and there were also signs of violence on her chest area." 

 

Choi is currently suing Kim Hyun Joong for 1.6 billion KRW (~$1.38million USD) in compensatory damage.

Kim Hyun Joong and his ex Ms. Choi attended the second plea date for Choi's ongoing lawsuit against Kim on July 8. 

 

Kim Hyun Joong's attorney Lee Jae Man informed OSEN on July 8, "The parties did not cross-examine each other. Each were questioned separately." 

 

Regarding Choi's testimony, Lee claimed, "[Choi] stated that she miscarried back in May of 2014 because she was assaulted by Kim Hyun Joong. When asked if she went to the hospital to request a false diagnoses, she answered that she did not. She keeps repeating the same statements using text messages and the pregnancy tester as the grounds for her claims. Now all we've got left is the last plea date on July 20 which only the lawyers will attend. Afterwards, [the courts] will deliver their sentence." 

 

According to reports, Kim Hyun Joong and Choi were interrogated for over seven hours starting from 2 p.m.

Ms. Choi to sue Kim Hyun Joong for using a fan club member as a witness

 

 

The struggle is nowhere near its end in the ongoing case between Kim Hyun Joong and his ex-girlfriend, Ms. Choi.

 

On July 19, Ms. Choi announced through her legal representative that she plans to sue Kim Hyun Joong for perjury. The representative explained, "Mr. Lee, who appeared as the witness at the trial on July 19, was discovered to be a fan club member. It is highly inappropriate to use a fan club member as a witness. Mr. Lee stated, 'Kim Hyung Joong hyung apologized to Ms. Choi on his birthday'; however, perjury is highly suspected. We will soon take legal actions against it." 

 

Currently, Kim Hyung Joong and Ms. Choi are battling for 1.6 billion KRW in compensatory damage.

Kim Hyun Joong continues to argue that Choi is lying about assault, miscarriage, + pregnancy

 

 

The final plea date between Kim Hyun Joong and his ex Choi was held on the morning of July 20 at Seoul Central District Court. 

 

Kim Hyun Joong and Choi once again tried and failed to reach an agreement. 

 

Choi's legal rep argued, "There are four causes for our damages suit: the pregnancy, assault, and miscarriage, which all occurred around May of 2014; [Kim Hyun Joong's] duty to pay the penalty; false charges of fraud and blackmail which were acquitted; and compensation for inflicting emotional distress." 

 

Kim Hyun Joong's legal rep rebutted, "Choi's damages suit is without sound basis. We demand the restoration of 600 million KRW (~ $520,000 USD) for the damages suffered from [Choi's] blackmail. We demand the 600 million KRW as [Choi] divulged [Kim Hyun Joong's] assualt when she had agreed not to. Because he is a celebrity, my client suffered a considerable amount of damage due to articles published in the media." 

 

Choi's lawyer, upon hearing Kim Hyun Joong's lawyer's argument that everything Choi claims about the pregnancy, assault, and miscarriage are fabricated, stated, "That's an overstatement. It's a shame that [Kim Hyun Joong] is using the X-ray Choi received to disprove her pregnancy. Kim Hyun Joong's lawyer is trying, through numerous press releases and interviews, to subject Choi to national censure. He tells her that he won't 'give her a single penny' even with a major label backing him and even though he will spend millions for a law firm. This serves to destroy Choi's reputation and character."

 

Kim Hyun Joong's lawyer argued back, "Choi only makes statements on the circumstance and fails to provide any detailed, scientific proof. Because the defendant is celebrity, he only suffers damages the more he appears in the media. We only took part in interviews because we felt pressured by the plaintiff. My client's reputation was directly affected because of the false claims that [Choi] suffered a miscarriage for her second pregnancy from assault and that she lived with him. Further, [Kim Hyun Joong's] private life was infringed upon due to the exposure of text messages between him and the plaintiff."

Kim Hyun Joong wins case against ex-girlfriend

 

 

Kim Hyun Joong has won the case against his ex-girlfriend A, who first sought damages for alleged assault and a subsequent miscarriage. 

 

On August 10, the Seoul Central District Court found in favor of Kim Hyun Joong in the long-fought case between him and his ex-girlfriend. Ms. A had sued Kim Hyun Joong for 1.6 billion Won (~$1.46 million USD) in damages for psychological distress and injuries, but she's now been ordered by the court to pay the star 100 million Won (~$91,400 USD) for defamation of character, psychological distress, fraud, extortion, and more.

The controversy began in August of 2014 when his ex-girlfriend A pressed charges, and though Ms. A was previously cleared of charges of defamation, fraud, and extortion, it appears the court found in favor of Kim Hyun Joong after his latest appeal this past June. He and Ms. A currently share custody of their child.
