There's no hope that Tao will stay, but SM only said that they are "negotiating", while Tao is having a lot of solo activities in China although he is supposed to be "injured". SM really does need to give the fandom a solid answer so people can stop holding out the small hope that he is going to come back Or if he is, just tell them. As you can see the paper dolls all have their Overdose design, so I guess they planned those merchandises since quite a long time. Maybe it's too expensive to cancel all of Tao's merchandises and a waste of money to basically throw them away (after they already had to do that with some of Kris's and Luhan's stuff). ATM both sides seem to have come to some sort of an agreement as SM hasn't said anything about Tao's solo endevours while Tao hasn't said anything about his name and face still being used in promotion. For example the LMR papertoy dolls that just came out with Tao included and with END that was still ongoing when news broke out. Different from Kris' case when SM desperately blurred out Kris' face in even the tiniest cuts on entertainment programs the minute he left. Kris and Luhan were also enterily cut from the Japanese 1st greeting DVD, while Tao is still included in the TLP dvd that will come out in 2 days. I suspect they worked out some deal to stay quiet until comeback is over and even then why announce it until their NEXT comeback?
